Statutory rape case dismissed
A magistrate on Tuesday dismissed charges against a man accused of having sex with a minor.
Prosecutors alleged that Marcian Farrington, 24, had repeated sexual contact with a 14-year-old girl during the period of August 2008 to July 2009.
The girl’s aunt reportedly picked up the phone while the child was having phone sex with a man. When confronted, the girl allegedly admitted that she had an intimate relationship with Farrington.
The girl claimed that she and Farrington had sex in the back of his car after school on several occasions.
Medical evidence confirmed that the teenager was sexually active, but she was not examined until four months after the last alleged coupling.
Magistrate Guillimina Archer agreed with submissions by defense lawyer Mark Rolle that there was no evidence to support the girl’s claims.
