Appellate court upholds murder conviction for ‘Die’ Stubbs & ‘Yogi’ Davis, sets co-accused free
The Court of Appeal today set free an accused cop killer and upheld the convictions of his two co-accused.
The appellate court quashed the murder conviction of Clinton “Russ” Evans while upholding the convictions of Stephen “Die” Stubbs and Andrew “Yogi” Davis for the 1999 murder of DC Jimmy Ambrose, who died at the now-closed Club Rock Disco after a fight between two rival gangs continued on the outside.
Stubbs, Davis and Evans were challenging their convictions on the grounds that the trial judge admitted various pieces of hearsay evidence; allowed dock identifications and gave inadequate directions in relation to identification evidence, among other things.
They were also contesting the constitutionality of their life sentences.
